Right of withdrawal for consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.)

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The cancellation period is fourteen days from the day

on which you or a third party designated by you, who is not the carrier, take possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered together, or
on which you or a third party designated by you, who is not the carrier, take possession of the last item, provided that you have ordered several goods as part of a single order and these are delivered separately, or
on which you or a third party designated by you, who is not the carrier, take possession of the last partial shipment or the last piece, provided that you have ordered goods that are delivered in several partial shipments or pieces, or
on which you or a third party designated by you, who is not the carrier, take possession of the first item, provided that you have concluded a contract for the regular delivery of goods over a defined period.

 

To exercise your right of withdrawal, you must inform us (Max Bischof GmbH, represented by Managing Directors Alexandra Bischof and Holger Bischof, Schmidsberg 2, 94130 Obernzell, Germany, telephone number: +49 8591 340) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired (e.g., by registered mail with return receipt requested).

Exclusion of the Right of Withdrawal

We reserve the right to exclude ordered goods from the right of withdrawal. This applies in particular to spare parts that we cannot return to our suppliers. Even if we accept the return of certain items, we reserve the right to charge a restocking fee. Used and installed spare parts are generally excluded from the right of withdrawal. The goods will be inspected upon return.

Consequences of Cancellation

If you cancel this contract, we will reimburse all payments received from you, excluding delivery costs (including standard shipping), but especially any additional costs incurred because you chose a delivery method other than the cheapest standard delivery offered by us, and excluding shipping costs exceeding those of standard postal parcels (this specifically applies to express and freight shipping), without undue delay and at the latest within fourteen days from the day on which we received your cancellation notice. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back in perfect condition. We reserve the right to inspect the goods at our premises to ensure they are in perfect condition.

You must return or hand over the goods to Max Bischof GmbH, Returns Department, Schmidsberg 2, 94130 Obernzell, Germany, without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods, including any additional costs incurred if delivery is unsuccessful.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. This applies to sewing machines in particular if they have been used to sew fabric.
